The Endangered Species Act (ESA) 2007 provides a high level of protection to Ontario's species at risk and their habitats. The new Act also has flexibility and balance built into it. The ESA 2007 includes important flexibility tools that encourage good stewardship and benefit to species at risk. These tools also support the social and economic well being of the province.

Under the ESA 2007, the government may enter into agreements or issue permits to assist with the protection and recovery of species at risk, and to address social and economic issues.
Permits
Permits authorize people to engage in an activity that may not otherwise be allowed under the ESA 2007. Permits may be granted under the following circumstances:
- The activity is necessary for human health and safety.
- The purpose of the activity is to help protect or recover the species at risk
- The activity will result in an overall benefit to the species
- Permits may also be granted for activities that result in significant social or economic benefit to Ontario. Even in these cases, the activity must not jeopardize the survival or recovery of a species at risk.
Stewardship Agreements
Agreements are just one of the tools under the ESA 2007 that support stewardship efforts. People and organizations can apply to enter into agreements with the government to engage in activities that may otherwise be prohibited under the Act. These are generally activities that are designed to aid in the protection or recovery of a species at risk.
Regulations
Regulations will be created that allow for certain activities otherwise prohibited under the ESA 2007. Any proposed regulations will be posted on the Environmental Registry for public review and comment.
