Under the Mining Act, the Mining and Lands Commissioner may be called upon to determine claims, questions or disputes in respect of a matter or thing concerning any right, privilege or interest conferred by or under the Act. The Mining and Lands Commissioner hears, among other things, disputes between claim holders, appeals from the decisions of Provincial Mining Recorders, appeals from the requirements, orders and declarations of the Director of Mine Rehabilitation and applications for vesting orders upon the death of the recorded holder of unpatented mining claims or for non-payment of rent or taxes by delinquent co-owners of lands or mining rights that are subject to rents or expenditures or are liable for tax.
The official version of the Orders of the Mining and Lands Commissioner and the Deputy Mining and Lands Commissioner is the signed original in the Office file. In the event that there is a question about content, the original in the Office file takes precedence.

The fee to file an application for a Vesting Order pursuant to sections 181(8) and 196(2) of the Mining Act, R.S.O. 1990, c M. 14, as amended, in the Office of the Mining and Lands Commissioner is $51.00 (Policy G.A. 301-9, Minister's Required Fees, MNDM). All cheques must be made payable to the Minister of Finance.
For all other appeals or applications there is no filing fee.
