1. Why has the OGDE Agreement been revised?
The 2002 agreement has expired and needed updating. With input from other organizations, MNR has revised the agreement to reflect current business practices, address feedback and attract new members.
2. What’s different?
- No Membership Fees
- Expanded eligibility requirements to allow additional organizations such as public utilities to join.
- Introduced language on direct and indirect licensing.
- Improved language on liability.
- Clarified requirement for insurance for specific member groups.
- The revised agreement does not expire.
3. Do current OGDE members have to sign the revised agreement Membership Application Form?
Yes. Current members have six months to sign the revised agreement Memberships Application Form from the time they receive it from MNR.
Note, Appendix 'A' Ontario Geospatial Data Exchange Licence Agreement does not need to be completed.
4. My organization is eligible to join the OGDE, who in my organization should sign the membership application form?
The OGDE Membership Application Form should be signed by an official who has the delegated authority to bind their organization to a legal contract. For example, for the Ministry of Natural Resources, this would be the Deputy Minister.
5. Where do I send the completed OGDE Membership Application Form?
Please provide two (2) copies of the Membership Application Form with the original signature of your signing authority and return both copies to the following address. The Appendices are optional and not required for membership.

6. Do members have to share data with other OGDE members?
Although sharing data with other members is encouraged, it is completely voluntary. Once data has been made available by a member it must be available to all members.
7. I don’t want to share data; can I still be a member?
Yes, the revised OGDE agreement acknowledges that some members may voluntarily exchange data while others members may only use data.
8. Do I need general liability insurance to become a member?
Yes, members are required to have general liability insurance unless they are part of the following groups: - OPS Ministries and Agencies
- Departments and Agencies of the Federal Government
- Ministries, Departments and Agencies representing Canadian provincial or United States federal or state jurisdictions outside Ontario
- Regional and local Municipal Governments including those outside of Ontario.
9. Do the appendixes A and B in the agreement need to be signed and completed to become a member?
No, only the membership application form has to be completed and signed to become a member.
10. What is Appendix A for?
Appendix “A” identifies members’ use of data distributed directly and indirectly within the exchange, does not require a signature, and Schedule 1 should be included in any exchange of geospatial data.
11. What is Direct Licensing?
Direct licensing is the process members follow to distribute their data themselves to other members. Members that use direct licensing must complete Schedule 1 of Appendix “A” Data Licence Agreement or Standard Licence with any data transferred.
12. What is Indirect Licensing?
Indirect licensing is the process members follow to distribute their data through the LIO Warehouse to other members using Appendix B or a Memorandum of Understanding (MOU).
13. What is Appendix B for?
Appendix “B” is for members that want to use the LIO Warehouse to disseminate their data to other members. OPS Ministries are required to complete a separate Memorandum of Understanding (MOU) with MNR.
14. Will we lose Intellectual Property (IP) rights if data is shared with other OGDE members?
No, members retain their IP rights for any data shared through the OGDE.
15. How can I put data into the LIO Warehouse for distribution to other members?
For members that wish to use the LIO Warehouse to disseminate their data they have the option of pulling together their data in a specific way called a packaged product and data is disseminated “as is” or it can be rigorously analyzed and standardized as a structured product for integration into the LIO Warehouse.Packaged Products are recommended for quick dissemination and Structured Products are recommended for integrating data and use with other LIO Services. Please contact LIO@ontario.ca for assistance with either option.

16. Can members sublicense data accessed through the OGDE?
Yes, all members can sublicense their agents and contractors. For more information see Appendix A Section 2.0.
17. Can we distribute members’ data to other OGDE members, agents, contractors and non members?
Members cannot distribute other members’ data without prior written approval from the member which made the data available.
Members may distribute derivative products made from member’s data provided they are in the form of paper or in digital format that emulates paper over the Internet.
18. How is data cited under the OGDE agreement?
All data from Ontario Ministries should be cited as: © 20XX Queen’s Printer. Other members should be recognized individually e.g. “Greater Municipality of Anywhere, 2010, All rights reserved.”
19. How are derivative products cited?
Derivative Products should cite the source data. e.g.”Source Data © Greater Municipality of Anywhere, 2011, All Rights Reserved”. If applicable, include additional proprietary notices set out in Schedule 1 of Appendix A.
20. What is the Central Distribution Facility?
The Central Distribution Facility used by the MNR is the Land Information Ontario (LIO) Warehouse. All OGDE members have access to data that is available for indirect licensing through the Warehouse.
An account is required to order data from the LIO Warehouse. To obtain an account, complete the subscriber information on the OGDE membership application form.

22. Are members required to fix errors in their data?
No, members are not obligated to report or fix data errors under the OGDE agreement. Errors can be redirected back to the member that owns the data. Errors can also be reported to the Land Information Ontario Support Team at (705) 755-1878 or lio@ontario.ca
23. Can we continue to use data accessed through the OGDE after my organization terminates its membership?
No, within 30 days after the effective date of termination, members should make reasonable efforts to delete all data, including updates and corrections, accessed through the OGDE.
