Forestry activities on Crown lands in Ontario are subject to a number of provincial and federal laws. Principle among the provincial laws is the Environmental Assessment Act. In the late 1980’s, to comply with this legislation, the MNR prepared an environmental assessment of the activities associated with forestry including building forest access roads, harvesting trees, conducting forest maintenance and renewing the forest. It also provided guidance on the preparation, review, and approval of forest management plans
In April 1994, after four years of hearings, the Environmental Assessment Board, which presided over the Environmental Assessment hearing on MNR’s request for a Class Environmental Assessment process for timber Management on Crown lands in Ontario, issued its decision. That decision approved a class EA process for approving timber management activities in Ontario, subject to 115 legally-binding terms and conditions.
In 2003 a review of the approval was conducted by MNR, as required by condition 114 of the approval, and an extension an amendment to the approval was sought and granted through the issuance of Declaration Order MNR-71. Condition 50 of Declaration Order MNR-71 requires MNR to continue to implement the original decision except as amended and extended by the Declaration Order.
