$402,000 Penalty For Operating Without A Licence

A Delhi aggregate company and its president have been fined a total of $402,000 under the Aggregate Resources Act for operating a quarry without a licence.

Nichols Gravel Limited was fined $197,500. Gary I. Nichols, the company’s president, was fined $204,500.

The court heard that Nichols Gravel Limited and Gary Nichols continued operating the quarry between October 7, 2004 and November 30, 2006 even though the Minister of Natural Resources had revoked the licence on September 30, 2004.

Justice of the Peace Prior Bonas convicted the accused in the Ontario Court of Justice, Cayuga on December 6, 2009 and assessed penalties at a sentencing hearing on January 27, 2010.
