Habitat Destruction Nets $10,000 Fine And Rehabilitation Order

A Toronto woman has been fined $10,000 for filling and dredging shore lands without a work permit, and also ordered to rehabilitate the site.

Nuala Kennedy was found guilty under the Public Lands Act on May 13, 2009, and sentenced on November 27, 2009.

Court was told that Nuala Kennedy hired a local contractor during the fall of 2006. The contractor dredged a large section of shore lands along Georgian Bay in The Town of The Blue Mountains, removing aquatic vegetation and back-filling the area with boulders and gravel.  None of this work was authorized by the Ministry of Natural Resources.

Justice of the Peace David Stafford heard the case in the Ontario Court of Justice in Owen Sound from May 11 to May 13, 2009.
