Failure To Appear Proves Costly
A Hamilton resident has been fined a total of $2,000 plus costs for failing to appear in court and breeching his probation. Dan Du of Hamilton failed to appear in court to provide testimony pertaining to an investigation involving endangered species.
The court was told that on January 21, 2008, Du entered into a plea agreement to provide further evidence and testimony in upcoming trials against co-accused individuals. As part of his original sentence, Du was placed on probation for two years requiring him to attend court as required. Du was additionally served a summons to attend the trial and testify on June 8, 2009. He disregarded both his probation order and summons and did not attend court to provide his required testimony.
Du was found guilty and convicted on both counts and was fined $1, 000 for each violation.
Justice of the Peace Calvin Hurst heard the case in the Ontario Court of Justice, Chatham-Kent, on October 28, 2009.
